New legal obligations and related controls in Poland
In the past, there was only a public register for WEEE and batteries in Poland, which was administered by the authority Główny Inspectorate Ochrony Środowiska (GIOŚ). For the packaging licensing, there has been no register so far.
This year, a joint central public register for packaging, WEEE (electrical appliances) and batteries was introduced, reporting to a newly established authority, the Baza Danych o Odpadach (BDO). The purpose of this authority is to close the gaps in the registration system and to make the registration status of all companies that place goods onto the Polish market more transparent. In consequence since July 23rd 2018, it is obligatory to include the BDO number on the business documents in Poland.
The costs for disposal of Packaging in Poland are significantly lower than e.g.: Germany, France or Hungary. By contrast however, the newly introduced Penalties are disproportionately high. Manufacturers and distributors who are already registered for electrical appliances are strongly advised to register for packaging at short notice in order to avoid these penalties.
