EPR in Hungary: Current Developments
The recent developments in Extended Producer Responsibility (EPR) in Hungary have significant implications for online retailers and companies distributing products such as packaging, textiles, electrical and electronic devices, batteries, and furniture in the Hungarian market.
This article provides an overview of the current developments in EPR in Hungary and highlights the obligations that affected companies must now fulfill.
Since July 2023, online retailers in Hungary must contribute to EPR fees for packaging, textiles, electrical and electronic devices, batteries, and furniture. They need to register with the concession company and fulfill take-back obligations. Packaging should be environmentally friendly. Textile and furniture retailers must develop take-back systems. Domestic and foreign companies selling products to end consumers in Hungary must register. Foreign companies require a Hungarian representative. Compliance with EPR regulations and promoting recycling are gaining importance.
Since July 2023, online retailers are obliged to contribute to EPR fees not only for their products but also for their packaging and shipping materials. This requires comprehensive registration with the concession company as well as with environmental and tax authorities.
Affected companies must also conclude a contract for disposal services and register with the aforementioned authorities, regardless of whether they submit their VAT returns via the OSS system in their own country.
EPR in Textiles, Furniture, and Packaging
Textile online retailers must prepare for take-back obligations and develop systems for the collection and recycling of old clothing.
For furniture retailers, this means considering logistics for the collection and recycling of (wooden) furniture pieces.
The packaging of online retailers should be as environmentally friendly as possible, as EPR fees also cover packaging materials. Reducing packaging waste and using recycled materials are becoming increasingly important.
Who is Required to Register?
Affected companies include companies based in Hungary as well as foreign companies selling packaged products directly to end consumers in Hungary.
Foreign companies subject to EPR obligations must appoint a Hungarian representative.
