From 1 January 2024, producers and online retailers of single-use plastic products will be required by the EWKFondsG to appoint an authorised representative to assume their obligations in Germany. Important Deadlines

The registration requirement on the DIVID platform applies to all companies that supply single-use plastic products to Germany. The timing of registration depends on the business activity:

  • Before 1 January 2024: Registration must be completed by 31 December 2024 at the latest.
  • From 1 January 2024: Immediate registration is necessary.
  • Before 1 January 2026 (fireworks): Registration must be completed by 31 December 2026 at the latest.

These regulations are equally binding on manufacturers, importers and distributors who introduce products to the German market or sell them there.

The challenges for foreign companies:

The EWKFondsG poses particular challenges for companies without a place of business in Germany. In addition to the registration requirement, quantity reports must also be submitted for the products placed on the market in order to ensure that the levies to the environmental fund are calculated correctly. Furthermore, tax assessments from the Federal Environment Agency must be carefully checked and corresponding payments made in due time.

This process requires a detailed understanding of German regulations and can be complex and time-consuming, especially for companies outside of Germany. Without local representation, compliance can cause additional work, both legally and administratively.
